acting on behalf of the Industrial Development Agency and the City of Radom and according to the Decree of Minister of Economy dated November 15^th, 2004 regarding tenders, negotiations and criteria for evaluating business ventures that are to be undertaken within Tarnobrzeg Special Economic Zone EURO-PARK WISŁOSAN (Journal of Acts No. 254, item 2549) and the Act dated August 21^st, 1997 regarding real estate management (Journal of Acts 2010 No. 102, item 651 with later amendments ) and the Decree of the Council of Ministers dated September 14^th, 2004 regarding means and methods of conducting tenders and negotiations for real estate disposal (Journal of Acts No. 207, item 2108 with later amendments).

invites to tender in order to:

determine the entrepreneur, who will be granted permit to operate business activity within Tarnobrzeg Special Economic Zone EURO-PARK WISŁOSAN and purchase of property right of undeveloped plot no. 19/9 at a area of 5,4783 ha located in Wośniki, Hodowlana str. in Radom.

1. The real estate mentioned above is located within TSEZ EURO-PARK WISŁOSAN, Radom Sub-zone. The owner of the plot (free of commitments and encumbrances) is Radom urban community. The District Court’s in Radom Sixth Department maintains the registers of deeds for real estate KW No. 97934/6.

2. According to the local urban development plan of the part of Radom city, on the area located Kielecka and Hodowlana str. passed due to the Resolution of Town Council No. 892/2006 dated October 16^th, 2006, the real estate is located in “UT.OK.ZT” zone, that is the zone of formation and concentration of objects of technical services, production objects and objects regarding the service of communication and grebe areas.

3. Details regarding the real estate, offer preparation and tender conditions are stipulated in “Specification of important tender conditions no. 2/RA/2011”, available at IDA Warsaw Branch Office in Tarnobrzeg ( 8:00 a.m. – 16:00 p.m.), 39-400 Tarnobrzeg, Zakładowa St. 30., tel./fax: (0-15) 823 66 88. Specification price is 12.300,00 PLN (23% VAT included) to be deposited into account number 19 1240 2744 1111 0000 4004 2516 at the Bank “PEKAO SA I O/Tarnobrzeg”.

4. Starting price for the real estate is 2.000.000,00 PLN gross.

5. The necessary condition of participation in tender is the purchase of Specification and payment of the bid security into the Town Council of Radom account number: 90 1240 3259 1111 0000 2989 2305 in the Bank PEKAO SA II O/Radom with the marking “Unlimited tender plot no. 19/9 range Wośniki “ The bid security should be made payable to the City of Radom not later than on the date of submitting offers. Document that confirms the payment should be submitted to the commission before opening of tender.

6.The bid security for tender is set at 200.000 PLN gross.

7. All costs connected with the purchase of real estates are paid by the buyer.

8. The buyer is obliged to submit the guarantee of realization of the investment in the form of bank guarantee with the expiry date at least one month longer than the period specified in the schedule of investment in the amount of 1.000.000,00 PLN (containing the information about irrevocable and unconditional payment the amount of 1.000.000,00 PLN in favour of Town Council in Radom, on the basis of the first written claim) or the protective security in the amount of 1.000.000,00 PLN, payable for the Town Council in Radom. Detailed information concerning realization of bank guarantee and forfeiture of protective security or its repaying is stipulated in “Specyfikacja istotnych warunków przetargu no 2/RA/2011”.

9. Evaluation of the offer in scope of economic projects will be made on the basis of criteria
stipulated in the Decree of Minister of Economy dated November 15^th, 2004 (Journal of Acts No. 254, item 2549).

10. Sealed offers are to be submitted not later than on September 26^th, 2011 at 16.00 p.m. the IDA Warsaw Branch Office in Tarnobrzeg, Zakładowa St. 30.

11. Offers will be opened in the presence of commission on September 29^th, 2011 at 12.00, at the IDA Warsaw Branch Office in Tarnobrzeg, Zakładowa St. 30.

12. Should the person determined as the real estate buyer be absent, without an excuse, at the place and time indicated in notice to finalize contract, owner of estate can withdraw from the transaction and the deposited bid security will not be reimbursed.

13. Tender participant can file a complaint against tender proceedings as described in §11 of the Decree of the Council of Ministers dated September 14^th, 2004 regarding means and methods of conducting tenders and negotiations for real estate disposal (Journal of Acts No. 207, item 2108).

14. IDA Warsaw as a managing authority will be able to:

a. abrogate the tender only for important reasons, in such case an appropriate notice including explanation will be made publicly available,

b. close the tender without selecting any offer,

c. annul the tender in case any significant change occurs resulting in situation where tender proceedings are not in agreement with public policy, which could not have been determined earlier or in a situation where tender proceedings are legally defect resulting in inability to issue a permit or conclude a valid real estate right devolvement contract. In such case the IDA will notify all parties providing legal and actual grounds.

15. According to the article 8 section 2 of the Act dated October 20^th, 1994 regarding special economic zones (Journal of Acts 2007, No. 42, item 274 with later amendments) the IDA as a managing authority has the pre-emption right to the real estate. Such right can be exercised on in the period of one month from the date of notice regarding conclusion of conditional purchase-sell contract.
